Wills – Questions to consider

Wills – Questions you should consider.

Executor Appointment

Your executor is the person (or people) you appoint to carry out your wishes after you pass away. This role involves collecting assets, paying debts, and distributing your estate.

Guardianship of Minor Children

If you have children under 18, your Will should appoint a legal guardian. This ensures that your children are cared for by someone you trust if both parents pass away.

Distribution of Assets

List how your estate will be divided among beneficiaries. Be specific about what each person is to receive (e.g., real estate, bank accounts, heirlooms).

Spousal Provisions

If you are married or in a de facto relationship, consider how your assets will be shared with your spouse. Many couples opt for mutual Wills or mirror Wills, where both partners leave their estate to each other, and then to their children or named beneficiaries

Funeral and Burial Instructions

You may wish to include preferences for your funeral, cremation or burial, and any religious or cultural rituals you want observed.

Specific Gifts and Donations

You can include specific bequests, such as leaving your jewellery to a niece or donating a sum to a favourite charity.

Residuary Estate Clause

This clause deals with any remaining assets not specifically mentioned in the Will. It ensures nothing is left to chance.
